Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Kluey ("Kluey," "Company," "we," "us," or "our") governing your use of the Kluey platform available at kluey.ai ("Service"). By accessing or using the Service you confirm that you are at least 18 years old, have the legal authority to accept these Terms, and have read and agree to our Privacy Policy.

2. Description of Service

Kluey provides an AI-powered educational tutoring platform for children in grades K–6 (ages 5–12). The Service uses artificial intelligence to deliver Socratic-method coaching in Math, Reading, Science, and Social Studies. The AI is designed to guide students through problems without providing direct answers.

Educational Disclaimer: Kluey is a supplemental educational tool and is not a substitute for qualified teachers, tutors, or educational professionals. Session quality may vary, and you should review your child's progress regularly via the parent dashboard.

3. Accounts and Eligibility

• You must be at least 18 years old to create an account.
• You are responsible for providing accurate account information and keeping it up to date.
• You are responsible for maintaining the security of your password and for all activity that occurs under your account.
• One account may manage up to four children profiles (subject to plan limits). Each child profile may only be used by that specific child.
• You must notify us immediately of any unauthorised access to your account at support@kluey.ai.

4. Subscription Plans and Billing

• Paid plans are billed monthly in advance. All prices are in USD and inclusive of applicable taxes where required.
• Your subscription renews automatically each month until cancelled. You authorise us to charge your payment method on the renewal date.
• Payment is processed by Stripe. By subscribing, you agree to Stripe's Terms of Service.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time via the Billing section of your account settings.
• Cancellation takes effect at the end of the current billing period. You retain full access until then.
• We offer a full refund within 7 days of your first paid subscription charge. To request a refund, email billing@kluey.ai with your account email.
• No refunds are issued for partial months or unused sessions beyond the 7-day period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to extract AI model weights, reverse-engineer prompts, or circumvent content filtering.
• Use automated tools to interact with the Service beyond normal use.
• Share your account credentials with others.
• Use the Service to generate, store, or transmit harmful, abusive, or inappropriate content.
• Interfere with or disrupt the Service's infrastructure or security.
• Use the Service to collect data about other users.

Violation of these terms may result in immediate account termination without refund.

6. AI Content and Accuracy

Kluey uses large language model technology provided by OpenAI. While we take extensive measures to ensure educational accuracy and child-appropriateness:

• AI-generated content may occasionally contain errors or inaccuracies.
• Parents are encouraged to review session transcripts via the History section of the dashboard.
• The AI is not a replacement for a qualified teacher and should be used as a supplemental tool only.
• We are not responsible for decisions made based solely on AI-generated content.

7. Intellectual Property

All content, software, trademarks, and technology comprising the Service are the property of Kluey or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended personal, non-commercial educational purpose. You may not copy, modify, distribute, or create derivative works from any part of the Service.

Session transcripts and learning data you generate remain yours. By using the Service, you grant us a limited licence to process this data to provide and improve the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KLUEY AI'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Termination

We may suspend or terminate your account at any time, with or without cause, with notice where reasonably practicable. Upon termination, your right to access the Service ceases immediately. Sections 7–11 survive termination.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any dispute shall first be submitted to informal negotiation for 30 days. After that, disputes shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, on an individual (not class-action) basis. Nothing herein prevents either party from seeking injunctive relief in a court of competent jurisdiction.

12. Changes to Terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
